THE FIRST 365

Terms and Conditions

These terms govern your purchase of and access to The First 365.

Effective August 19, 2026

1. Agreement and operator

The First 365, operated by Marko Gligorić, provides the product described in these Terms. References to "The First 365," "we," "us," or "our" mean the product brand and its individual operator, Marko Gligorić.

By accessing or purchasing The First 365, you agree to these Terms and Conditions and the policies linked from them. If you do not agree, do not use or purchase the product. You must be legally able to enter into this agreement in your location.

2. The product

The First 365 is a one-time digital homeowner guidance product for first-time homeowners. It creates a personalized 365-day roadmap from questionnaire answers and provides a home organizer for plan progress, appliances and warranties, expenses, trusted professionals, emergency information, and document index records.

The product is currently designed for homes in the United States. Personalization is generated from the information you provide and general product rules. It is not an inspection or an assessment of the actual condition of your home.

3. Account access

You can complete the questionnaire, preview, and checkout without signing in. After purchase, a Google account with the same email address used for the purchase is required to securely connect the purchased plan and access it later. You are responsible for maintaining control of that Google account and for the accuracy of the information you provide. A successful sign-in does not grant paid access unless our server-side records confirm that the account owns a valid paid plan.

4. Purchase and payment

The displayed price is a one-time payment for access to the purchased personalized plan and the included home organizer. It is not a recurring subscription. Any taxes and final transaction details are shown by Paddle during checkout.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

As Merchant of Record, Paddle conducts the payment transaction under Paddle's applicable buyer terms and policies. Your right to access the product may end if the transaction is refunded, reversed, charged back, fraudulent, or otherwise invalidated.

5. Permitted use

We grant you a personal, limited, non-exclusive, non-transferable right to use The First 365 for your own household, subject to these Terms. You may not sell, sublicense, reproduce, scrape, reverse engineer, interfere with, bypass access controls for, or use the product to violate law or another person's rights. You may not attempt to access another user's plan or data or disrupt the service.

6. Your information and responsibilities

You retain responsibility for the information you enter. You confirm that you have the right to store it and that it is accurate enough for your intended use. Do not use The First 365 as the only repository for information you cannot afford to lose. Keep independent copies of critical emergency, insurance, warranty, legal, and property records.

7. Educational and organizational guidance

The First 365 provides general educational and organizational homeowner guidance. It is not a substitute for a licensed contractor, electrician, plumber, engineer, architect, inspector, lawyer, financial professional, insurer, emergency service, utility, or other qualified professional.

Do not rely on the product to diagnose hazards, determine code compliance, assess structural conditions, or direct dangerous work. Use appropriately licensed professionals for structural, electrical, gas, plumbing, roofing, fire-safety, hazardous-material, regulated, or other high-risk work. In an emergency, contact emergency services, the relevant utility, or a qualified professional immediately.

8. Intellectual property

The product, brand, design, software, written guidance, organization, and other materials supplied by The First 365 are protected by intellectual-property laws and remain the property of their respective owner. These Terms do not transfer ownership to you. Your own home information remains yours, subject to the permissions reasonably needed for us and our providers to operate the product.

9. Availability and changes

We aim to keep the product available, but uninterrupted or error-free access is not guaranteed. Maintenance, security incidents, provider outages, legal requirements, or product improvements may affect availability. We may update features, guidance, or supported technology while preserving the essential nature of a valid purchase where reasonably possible.

10. Suspension and termination

We may restrict or terminate access when reasonably necessary to address fraud, abuse, security risk, unlawful use, a reversed or refunded transaction, or a material violation of these Terms. Where practical, we will provide notice and an opportunity to resolve the issue. You may stop using the product at any time and may request account deletion under the Privacy Policy.

11. Disclaimers

To the extent permitted by law, The First 365 is provided on an "as available" basis. We do not promise that every recommendation applies to every property, that all information is complete or current, or that following the guidance will prevent damage, injury, expense, or other problems. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

12. Reasonable limitation of liability

To the extent permitted by law, The First 365 is not responsible for indirect, incidental, special, or consequential loss arising from use of or inability to use the product, or from decisions, contractor work, home conditions, or information outside our reasonable control. Any direct liability will be limited to the amount paid for the product giving rise to the claim. These limits do not apply where prohibited by law, including liability that cannot be limited for fraud, intentional misconduct, or personal injury.

13. Consumer rights

These Terms do not limit mandatory consumer rights available where you live. The governing law and dispute rules that apply will depend on the operator information and consumer protections applicable to the transaction. Paddle's buyer terms govern the payment transaction.
